Agreement

By accessing or using ProdSimulator’s website, applications, or related services (collectively, the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

The Service

ProdSimulator offers tools for running and evaluating technical interview simulations. Features may change; we may add, modify, or discontinue functionality with or without notice.

Accounts

You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. You must provide accurate information and notify us promptly of any unauthorized use.

Acceptable use

You agree not to:

  • Use the Service in violation of law or third-party rights;
  • Attempt to probe, scan, or test the vulnerability of the Service without authorization;
  • Interfere with or disrupt the Service or other users’ use;
  • Use the Service to transmit malware, spam, or harmful content;
  • Reverse engineer or attempt to extract source code except where permitted by law.

Your content

You retain rights to content you submit. You grant us a limited license to host, process, and display that content solely to operate and improve the Service for you. You represent that you have the rights needed to grant this license.

Intellectual property

The Service, including its design, text, graphics, and software, is owned by ProdSimulator or its licensors and is protected by intellectual property laws. Except as expressly allowed, you may not copy, modify, or distribute our materials without permission.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRODSIMULATOR AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR FIFTY US DOLLARS (US $50), IF APPLICABLE.

Indemnity

You will defend and indemnify ProdSimulator against claims arising from your use of the Service, your content, or your violation of these Terms, to the extent permitted by law.

Termination

We may suspend or terminate access to the Service if you breach these Terms or if we need to do so for legal or operational reasons. You may stop using the Service at any time. Provisions that by their nature should survive will survive termination.

Governing law

These Terms are governed by applicable law in your jurisdiction, without regard to conflict-of-law rules, except where mandatory consumer protections require otherwise.

Changes

We may update these Terms from time to time. We will post the revised Terms and update the “Last updated” date. Continued use after changes constitutes acceptance. If you do not agree, stop using the Service.
